Audaces, as the Audaces Apparel Software Vers. 11 and 12 developer and rights owner, after stop selling Audaces Apparel Vers. 11 and 12, communicates that, after the 10th of November 2018, it will be officially and irreversible discontinued. Therefore, Audaces will not offer training neither technical support for this products.
Audaces offers, for all of its clients and users, superior technology and versions than the softwares TOP 11 and 12, and that are already available to be bought.
This discontinuity is supported by the Software Law, the Copyright Law, the Intellectual Property Law, and the International Copyright Law (L n. 9.609/98 art. 8, L n.9.610/98, art. 7, XII c/c 24, I, VI, c/c 27, 28, 30 and 37; EC Software Directive of 14 May 1991, 91/250/EEC, published in the Official Journal of the EEC of 17/05/91, L122/42). Audaces Apparel softwares are and always were Audaces property, and its property rights are non transferable due to its juridic nature. Audaces makes available to customers and users only the LICENSE TO USE and it can be revoked at any time by the copyrights owner. The user license does not transfer property, only authorize the use of someone else’s intellectual and authorial product, and prevents the sale, alienation, transfer or donation to a third party. It is all provided for in specific law and, also, the user license agreement.
In case of burn, loss, stealth or any type of defect or damage caused to the supplies, Audaces will not be able to replace or compensate it to the user, because they are not produced or sold anymore, and are totally discontinued. It is the users sole responsibility for its choice of not update the system and hardware versions.
The consumer rights was fully secured by the previous publicity and communication of the discontinuity. By the legal nature of the property in question and by the provision of a Specific Law, the discontinuity is fully viable once it was previously communicated to the user, just as Audaces has proceeded.
