Dear customer,
In the use of attributions as the developer and copyright holder of the software Audaces Pattern and Audaces Marker versions 13 (thirteen) and 14 (fourteen); Audaces Idea 5 (five), 6 (six), and 7 (seven); and Audaces Digiflash versions 3 (three) and 4 (four), Audaces announces that, from December 19, 2022, it will officially and irrevocably discontinue these outdated versions, quitting the technical support and training for these products.
To provide a better experience for customers and users of Audaces technologies, updated versions of these systems are already available for purchase.
The act of discontinuance is supported by Brazilian Software Law, Copyright Law, Intellectual, and Industrial Property Law, besides International Copyright Law.
We emphasize that Audaces Pattern, Audaces Marker, Audaces Idea, and Audaces Digiflash software are and have always been the property of Audaces, which holds non-transferable property rights due to its legal nature.
Audaces only offers the USE LICENSE to its customers and users, which can be revoked by the copyright holder at any time.
The use license does not transfer ownership (only authorizes the use of someone else’s copyright and intellectual product) and prevents the sale, alienation, transfer, or donation to third parties – situations already provided for in the Specific Law and even in the license agreement of use.
The security plug or the CDs that accompanied the use licenses for these discontinued versions were just the vehicle (hardware) for the software and not the object of the legal transaction between the parties.
In the event of burning, loss, misplacement, theft, or any defect or damage to these supplies, Audaces will in no way be able to replace them or compensate them to the user, as they are no longer produced, sold, and completely discontinued.
Therefore, the incidents are the sole responsibility of the users who chose not to update their system and hardware versions.
The consumer’s right was fully guaranteed by the publicity and prior communication of the act of discontinuity.
Due to the legal nature of the good in question and the provision of a Specific Law, discontinuance is practicable once previously communicated to the user – exactly as Audaces has been proceeding.
